Train Mountain Promotional Video Contest 2014 Official Rules and Regulations
Just as in the reality TV show “The Pitch,” contestants are invited to compete for the best promotional video of Train Mountain. Using your creative ideas and skill, the objective of the contest is to encourage people to visit Train Mountain. The winning videos will be used to promote the 2015 Triennial through the Train Mountain YouTube channel and other social media sites or forums.
This Promotional Video Contest is intended for viewing and participation by those interested in the betterment of Train Mountain and shall be subject to and construed in accordance with the laws of the State of Oregon, and the federal laws of the United States of America that are applicable therein. Entry into this Contest constitutes your acceptance of these Official Rules and Regulations. Any Contestant under the age of 18 (Minor) at the time of entry requires parent/legal guardian approval to enter the Contest. By entering this Contest, the contestant irrevocably licenses all rights, including copyright, in the video to the Contest Sponsor.
1) AGREEMENT TO OFFICIAL RULES
By participating in the Contest, the contestant fully and unconditionally agrees to and accepts these official rules and regulations and accepts the decisions of the Train Mountain Railroad Board of Directors 36941 South Chiloquin Road, Chiloquin, OR 97624 (the “Contest Sponsor”), and/or their duly authorized agents, which are final and binding in all matters related to the Contest. Whether a Selected Contestant receives a prize is contingent upon fulfilling all requirements set forth herein as well as reaching a minimum cumulative score.
NO PURCHASE NECESSARY, nor are participants required to be past or present members of Train Mountain. The TMRR “Promotional Video Contest 2014” (“the Contest”) is free to enter and open to anyone interested in the betterment of Train Mountain Railroad; US residents and foreign contestants are equally permitted to submit entries. Employees (or those with whom they are domiciled) of the Contest Sponsor, Train Mountain Board of Directors, and their duly authorized agents are ineligible to enter the Contest. Minors (persons under the age of 18 years) at the time of entry will require a parent or legal guardian’s permission to proceed with the entry process (see video release form).
3) CONTEST PERIOD
The video submission portion of the Contest opens Thursday May 1, 2014 at 9:00 a.m. Pacific Time (“PT”) and closes Monday, October 20, 2014 at 5:00 pm PT. The voting portion of the Contest commences with the opening of the contest and ends on or before February 28, 2015 11:59 pm PT. The contest can end prior to the February 28, 2015 date if all eligible entries received by the October 20, 2014 closing date have been judged with scores finalized and reported to the Train Mountain Railroad Board of Directors.
4) HOW TO ENTER
Train Mountain will have first right of publication; contest entries that are broadcast, publicly or privately, prior to June 29, 2015, will be disqualified or winner will be subject to revocation of awarded prizes. Participants must produce a video in accordance with the rules of the contest that encourages people to visit Train Mountain. Copy your video to a disk or USB flash drive and mail along with the contest video release form that has been signed and initialed, as needed, with your complete name, address, phone number, email, address, age at time of entry, as well as your video title. Maximum of three video entries per person. All entries must be received by 5:00 p.m. (PT), October 20, 2014, the contest closing date. The Contest Sponsor is not responsible for any entries delayed, incomplete, destroyed, mutilated, lost or misdirected. Movies may include still photos and graphics, but must contain at least 70% video footage (Example: a 5 minute video must contain at least 3.5 minutes of video footage). Movies may include music that is royalty-free or music lawfully purchased with rights for public broadcasting, provided the music is properly acknowledged in the video's credits in accordance with YouTube and Vimeo standards.
Movies must include both a title at the beginning and credits at the end. The closing credits must give Train Mountain the rights to use this video with the following language including contestant name:
“This video was created by (Joe Contestant) for the exclusive use by Train Mountain as defined within the official rules and regulations of the TMRR Promotional Video Contest 2014.”
Use of the Train Mountain logo is permitted by the contestant within the video entry. The video is not to exceed 5 minutes in length but must be at least 1 minute long; file size not to exceed 400 MB (finalists will be asked to send a full-size copy at the close of the contest). Time dated material that would make the video obsolete in the future, such as the 2014 'run your train for free' offer, should not be included in the video. Each video must
meet all guidelines and criteria imposed by YouTube and Vimeo with respect to videos submitted to YouTube and Vimeo. Videos may be enhanced with graphics, special effects, animation or music.
Royalty-free music is now available through YouTube at www.youtube.com/audiolibrary. All videos must be in English.
By submitting a video to TMRR in this contest you represent and warrant that you are the original creator of the video; that you are the sole owner of the copyright and all other rights in the video and all content in and on the video (or have written authorization from content owner); that the submitted video meets all of the video eligibility requirements set out in these rules and those of YouTube and Vimeo.

The prizes must be accepted as awarded, have no cash value other than the prize itself, cannot be transferred, substituted, added to or redeemed. All prizes may or may not be awarded at the sole discretion of the Contest Sponsor. All decisions of the Contest Sponsor and the appointed judging panel are final. The Contest Sponsor reserves the right to cancel this promotion at any time for any reason whatsoever. The Contest Sponsor reserves the right to substitute other prizes of equal or greater value if any of the prizes offered are unavailable for any reason.
A judging committee consisting of one member of the Train Mountain Railroad Board of Directors and two authorized representative team members selected by the board will review all video submissions and score each video against elements in the judging criteria. Any ties or discrepancies that require a subsequent vote will be handled by the remaining members of the board (the Contest Sponsor reserves the right at its sole discretion to substitute another outside judge if any of the judges are unavailable for any reason). Judges will independently review each video using a common judging criteria sheet. The judging panel will review the participants’ written release forms and score each video against elements in the judging criteria sheet. Video entries must achieve a minimum cumulative score to qualify for a prize. The video which achieves the highest score in excess of the minimum cumulative score will win the Grand Prize. The video which achieves the second highest score in excess of the minimum cumulative score will win the Consolation Prize. Subsequent videos which achieve a score in excess of the minimum cumulative score may receive the Honorable Mention Prize at the discretion of the Train Mountain Railroad Board of Directors.
30%- How compelling is the video at encouraging viewers to visit Train Mountain?
30%- How creative is the delivery of the message? Creativity meaning, for example, originality of video concept, use of music, photos, graphics and overall style.
25%- How well is the video produced in regards to continuity, timing, camera operation, sound quality, and editing?
15%- Does the video follow the guidelines of video length, file size, video-to-still photo ratio, video title and closing credits with the specific language outlined in Section 4 above?
5 Point Bonus: All entries are required to complete a video release form. A bonus will be given for those entries with properly completed video release forms. Those forms that are incomplete, illegible, or otherwise require the contest sponsor to request corrections by the contestant to the original form will not qualify for the bonus.
7) GENERAL CONDITIONS
All video entries become the property of the Contest Sponsor, may be used by TM for promotional purposes on their website, news media and social media networks such as YouTube and Facebook and will not be returned. Contest Sponsor reserves the right, to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Contest Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Contest Sponsor in its sole discretion. The Contest Sponsor has the right to verify a contestant’s eligibility and compliance with these Contest Rules, and to disqualify a contestant on the basis of its investigation in its discretion.
8) LIABILITY PROVISIONS
The Contest Sponsor, and the appointed judges are not responsible for human error, theft, destruction, or damage to your entry, or other factors beyond its reasonable control. You assume all risk of damaged, lost, late, incomplete, invalid, incorrect or misdirected entries. The Contest Sponsor makes no warranty, representation or guarantee, express or implied, in connection with its ability to in any way enable, develop or market the idea set forth in your entry. The Contest Sponsor shall not be liable to a winner or any other person for failure to supply the Prize or any part thereof, by reason of the Prize becoming for reasons beyond the reasonable control of the Contest Sponsor unavailable or impracticable to award, or for any force majeure event, technical or equipment failure, terrorist acts, labor disputes, or act/omission of any kind (whether legal or illegal), transportation interruption, civil disturbance, or any other cause similar or dissimilar beyond the Contest Sponsor’s control.
By entering information on the Contest Video Release form, you consent to the use of such information to administer, implement and fulfill this Contest. All personal information of participants gathered through the Contest (“Personal Information”), such as name, address, telephone number, e-mail address and age is collected solely for the purposes of administering this Contest. Personal information will not be provided to any third party, other than as provided for in these Official Contest Rules and Regulations. You further authorize the Contest Sponsor, the appointed judges or its representatives to communicate directly with you by electronic means or phone as needed to administer this Contest.
